Mr. Hemmingway Saisi wrongly jailed for murder he never committed.
Jersey City, NJ: His lawyer Mr. Anthony Gualano of West Orange failed to call witnesses to testify in court. Even his wife Ms Shamekia Saisi was never called to say whether Mr. Saisi did have a kitchen knife as it was reported, whether she had an affair with her stabbed cousin who died from the fight and how many people were fighting her husband.
Mr. Saisi was falsely accused of murder. He was found guilty and the charge was reduced to reckless manslaughter. He was sentenced to serve four years of which he could get out after serving 85% with good behavior.
Mr. Saisi was remanded for 16 months at Hudson County jail, he was jailed at Northern State Prison in Newark for 1 year, NJ and was then transferred to Trenton State Prison for I year.
According to Mr. Saisi his lawyer appealed the ruling but the appeal never made it to the judges. Mr. Saisi says My lawyer sold me to the prosecution, there was no case to take me to jail and yet he never called witnesses who saw how they were beating me.
Mr. Saisi regrets that he was arrested for being an African along with biasness and double standard from the police. The men who came to attack him had called him few minutes before he stepped out to go to work. When he got outside he was surrounded by three men who came out of the car one of them being the deceased, a cousin to his wife (US Citizen). The three men jointly drove him to the ground and started beating and kicking him.
While on the ground receiving blows and kicks as his wifes cousin sat on him, one of the other two took a knife and stabbed him mistaking him to be Mr. Saisi. The cousin to his wife who mistakenly stabbed started crying and his accomplices panicked and left the knife there and ran away.
Mr. Saisi tried to pick that knife but cut himself half of two right hand fingers. He took that knife for self defense and waited for the police who took him to hospital and arrested him afterwards for what he did not do.
Mr. Saisi claims that the cousin to his wife was on parole at that time while having a sexual affair with his wife He had just come out of jail, says Mr. Saisi and one of the accomplices he came with was on probation whereby they attacked him in front of his house.
Mr. Saisi says while in jail Correction officers beat him up for disobeying their request of suing the State for wrongful arrest and imprisonment if they give him a referral lawyer where they could get a percentage of the settlement.
Other inmates beat him up after being informed that he was an African and the circumstances of his case. I want Kenyans to know that I never went out of my house with a knife, but grabbed that knife at crime scene which they had, for self defense.
The deceased was a cousin to my wife who he had an affair with and the men were drug dealers that is why I never wanted them in my house says Saisi.
He was supposed to come out of jail on 08/24/07 where again they circulated propaganda that delayed his release until 10/24/07.
He is planning to appeal the ruling and have his record set straight as State Justice saw some fault in it.
Saisi family used to live on 148 Old Bergen RD in Jersey City; after this incident Ms. Shamekia Saisi moved to Atlanta, Georgia where her family resides and Saisi resides in Jersey City, NJ with his sister and dad.

I say thank you for the mere fact that many Kenyans decided otherwise and worked very hard in making Hemmingway and family face this nightmare on the most part by themselves. His mother has never seen such hatred and false information from her own people. Hemmingway went through hell for something he never did. And when I tried my best to inform our Kenyans about the travesty- a few misguided people worked 24/7 to discourage support. The nightmare was made worse by the lack of the Kenyan New Jersey support, even when those in Maryland/DC stood up and tried their best- the same Jersey City advocates of lies started spreading the same rumors to the supportive community of DC headed by Andrew Onwonga. The Saisi family is indebted to the DC Kenyan Community and God will reward them accordingly.
Nonetheless God shielded Hemmingway and he survived, the journey he now faces is tough but at least he is out. Assumptions and envy are the main problems in our community. The police and New Jersey State Judiciary system though known for their biased and ruthless treatment of Blacks- more so if African immigrants will one day face their just rewards. This is something that has to be address by U.S.A federal officials at some point- we the Saisi family will never rest- even if we have to carry this fight from other shores of this land.
Some issues on Hemmingways case that are questionable:-
His Bail file disappeared from the High court-
His attackers- though known criminals were never arrested prior to the attack for violation of their parole.
The attackers cars or homes were never searched for critical information.
Priory aggregated assaults by the deceased were never taken into account- despite his parole violations. Three attacks on some party- whom by the way the state later used as a character witness for the deceased- she lied under oath- amazing democratic U.S.A
Intimidation and subsequent beatings whilst incarcerated Medicated and placed in isolation all ploys to kill his spirit of I am innocent. The discrepancies on the trial itself leave many questions on the justice and corruption of the New Jersey State system. E.g. No transcriber- our advice never accept any taped trial demand a court transcriber- that is a solid tamper proof system. We never thought they could be so arrogant and obvious in their cover up.
The jury- that also is one open case- including the exclusion of jury 11 ands 12 (mother and big man-the size of the attacker go figure) from the final 12. None jury person entering the jury room during deliberation- when asked they said he was a repairman who didnt know otherwise- we found out that was a lie.
The amounts of evidence pre and during trial are enough, but remember we are dealing with parties that think they are above the law or humanity itself because they are Americans. We will not even start to mention the appeal cases- Lord has mercy, but I will die first before I give up. I never when the days were darkest and will not Know. I do not wish this even on those I call my life enemies- No other family should go through this kind of police, legal or prison system abuse basically human rights and judicial abuse at all levels.
The questions many people ask even those in England/The Hague-Netherlands – ask? When are they (New Jersey State) going to admit they sentenced an innocent man, and by sentencing Hemmingway Saisi they encourage thugs born and bred in the U.S.A to terrorize innocent hardworking immigrants especially Africans!
